The webshop of www.modekleding.be (hereinafter: the "website") is operated by and is owned by Sportief BV

The general terms and conditions are determined by Sportief BV with registered office at 2440 Geel, Pas 18 Belgium. VAT number: BE 0473 200 048 trading under the name www.modekleding.be. By completing the purchase and making the payment, the customer agrees to these terms and conditions. At all times, Sportief BV reserves the right to change the terms and conditions and the customer bears the responsibility to follow them.

We offer customers the opportunity to purchase clothing, accessories and other products from our online store online. These General Terms and Conditions ("Terms and Conditions") apply to every order placed by a visitor to this e-commerce website ("Customer"). Placing an order through the www.modekleding.be webshop  implies that the Customer has consulted these Terms and Conditions and  expressly accepts the applicability of these Terms and Conditions, to the exclusion of all other terms and conditions. Additional terms and conditions of the Client are excluded, unless they have been expressly accepted by www.modekleding.be in advance, in writing  .

To place an order, you must be of legal age. If you are still a minor, you are not allowed to place this order. This must be done by your parents or your legal representative.

1a. Acceptance of the order

Sportief BV is only bound by an order after it has been confirmed by info@modekleding.be by e-mail or after its execution has started.

Sportief BV is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stipulated otherwise. All product information, pricing and order information remain subject to possible changes and corrections at all times.

 

Article 2. Price

All prices quoted are expressed in EURO, always including VAT and all other taxes or taxes to be borne by the Customer, price changes and typographical errors reserved.

If delivery, reservation or administrative costs are charged, this will be stated separately. The price quote only refers to the items as it is described verbatim. The accompanying photos are intended to be decorative and may contain elements that are not included in the price. Also not included in the price are surcharges such as the recupel contribution and the costs of delivery. In any case, these additional costs are explicitly stated on the order form, i.e. before you place the order. Please read this carefully.

www.modekleding.be reserves the right to change the prices of the goods, in particular when a legal price-determining factor gives cause to do so.

Prices of the purchase may differ in the event of an exchange. When exchanging the same item, the amount of purchase may differ regardless of whether it has been deducted online. In the event of an exchange for another item, the purchase price will simply be deducted from the new item.

Article 3. Offer

Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. If the Customer has specific questions about e.g. colours, quantities, availability, delivery time or delivery methods, we ask the Customer to contact us in advance via info@modekleding.be.

The offer is always valid while stocks last and can be adjusted or withdrawn at any time by www.modekleding.be.
www.modekleding.be cannot be held liable for the unavailability of a product.

Article 4. Online Purchases

By confirming the order you agree to our Terms and Conditions, prices and descriptions of products. We reserve the right to block your order if the delivery address is incorrect or in case of problems during payment. The order is accepted and confirmed by entering data on successive pages/screens:

  1. Add the chosen products to the basket;
  2. Confirm the shopping basket with the order;
  3. Enter data;
  4. Pre-purchase information;
  5. Acceptance of these terms and conditions of sale;
  6. Choose and confirm payment method.

All payments on the website are processed via the payment platforms Mollie and Docdata Payments (CM), but payment can also be made via PayPal or by bank transfer.
The Customer has a choice of payment methods Bancontact, Visa, Maestro, Master Card,

Mister cash, Home banking, IDeal, PayPal, KBC, Sofort uberweisung, ebanking, Giropay, Belfius Pay, CBC, ING Home Pay and bank transfer and many other payment systems, which can be found after placing an order, after which you will be redirected to the payment platforms of Mollie or Docdata Payments (CM)

Our payment systems are secure and are done on the payment platforms of Mollie and Docdata Payments (CM). This is done via an SSL-secured server that sends credit card details securely.

www.modekleding.be is  entitled to refuse an order (in writing) due to a serious failure on the part of the Customer with regard to the order or any other order or agreement in which the Customer is involved.

Article 5. Delivery and execution of the agreement

Shipping & Delivery:

After the payment has been completed and the money has been received in the account, our packages are carefully packed with sustainable materials. They are then sent via Bpost  or PostNL or DpD, which in turn ensure the safe delivery of the package.

The delivery time fluctuates between 1 day and 10 days. This depends on which location these items come from and the delivery period of the postal companies.

The delivery time of clothing in (Pre)reservation or pre-order, we often give the customer the opportunity to place a pre-order on clothing that is in full development or production, this is to provide the customer with certainty that this clothing is already recorded for them for development. The delivery time will be communicated with the article,  This depends on the manufacturer and the period of delivery by the manufacturer.

The customer can choose between 3 delivery options:

1) Delivery to the home address or address of your choice

2) Delivery to a post point: a post office or approved point nearby

3) Delivery to a postal machine: The parcel lockers are open 24 hours a day, 7 days a week. All it takes is for the customer to register and choose a parcel locker in their area from which they want to send or pick up parcels (currently not yet available in all towns and cities).

During the purchase process, the customer can clearly indicate this via a module. You will be notified by e-mail or text message whether the package has been delivered to the post office of your choice. If you choose delivery to a home address, you will not receive an automatic notification.

Customer Tracking Number will be communicated via email upon request.

The customer is responsible for entering a correct address. Sportief BV is not liable for an incorrect delivery. The customer bears additional shipping costs if the package has to be resent due to entering an incorrect address.

The shipment will only be completed after payment of the fee.

Currently, shipments are limited to Western Europe. If you still wish to order from a different country than mentioned in the list, this can be requested, but the shipping costs will be higher, and it is possible that the order will be cancelled by www.modekleding.be for no reason  .

We currently use free shipping only valid for complete purchase. This can be changed at any time. (This is only valid for Belgium, the Netherlands and Germany), but is not valid for items in sales, sale, tying and discounted items, or items with a discount coupon.

Any shipping costs will be indicated in the shopping cart before the Customer places his or her order and will be calculated as follows:

  • For Belgium:
    • Private orders: €7,95
  • For the Netherlands and Luxembourg:
  • Individual order: €7,95

Since our order processing system cannot take all these criteria into account, it is possible that the delivery cost price is higher or lower than that stated on the order confirmation. This will be communicated to you within 3 working days. These shipping costs are also due if the order cannot be delivered or if an order is partially or fully returned

Delivery is made through our partners (Bpost, PostNL or DpD), a 'Handling company' that is responsible for the shipment of your order. The delivery to your home is taken care of by our logistics partner for Belgium who chooses which delivery service will deliver your order. If you are not present or if the package cannot be delivered, you will receive a pick-up notice with which you can go to the post office or post point in your area.

www.modekleding.be cannot be held responsible for any customs fees that would be associated with the delivery of foreign goods. These costs are to be borne by the Customer, but will be clearly indicated why and how much they amount to when placing the order.

Unless otherwise agreed, the ordered goods will be delivered between 1 to 10 working days (or if otherwise stated) after receipt of the order at the address indicated by the Customer at the time of ordering. This delivery time is purely indicative: failure to comply with the delivery time cannot give rise to any compensation on the part of www.modekleding.be since the delivery times are given for information purposes only and without any obligation.

It is possible that the Customer has nevertheless received a confirmation of a product whose stock is exhausted. It is also possible that the delivery is delayed due to circumstances for which www.modekleding.be is not at fault. If www.modekleding.be does not deliver within the agreed delivery  period or – if no delivery date has been agreed – within thirty days following your order, the Customer has the right to cancel the purchase and receive a refund, unless the product is on its way to the Customer.

Any visible damage and/or qualitative shortcoming of an item or other shortcoming in delivery must be reported immediately by the Customer to info@modekleding.be . The Customer is obliged to inspect the delivered goods upon receipt. If the delivered goods are not in accordance with the agreement (wrong or underdelivered, and/or with an error or damage), the Customer must report this in writing immediately after delivery of the goods by e-mail to info@modekleding.be .

The risk of loss or damage shall pass to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk is already transferred to the Client upon delivery to the carrier, if the carrier has been instructed by the Client to transport the goods and this choice was not offered by www.modekleding.be .

Pick up the package yourself:

For those who do not want to pay shipping costs, this can be done in our physical store in Geel, Pas 18, during opening hours or by appointment (preferred) via info@modekleding.be. This must be reported immediately at the time of purchase.

Sportief BV cannot be held responsible for sending the package if it has not been clearly conveyed. Contact: Info@modekleding.be

Exchange:

Sportief BV gives the possibility to exchange the products within a period of 14 days after the purchase. After this period has expired, it is no longer possible to exchange.

The conditions for an exchange are the following:

You send an e-mail to info@modekleding.be in which you  mention the order number and which item you want to exchange. It should be stated whether you will return it yourself or send it via Bpost, PostNL, DpD.

· The customer will receive an email with the way in which the package can be returned

· The customer returns the garment in sturdy packaging to Sportief BV via personal delivery to our physical store - Pas 18, 2440 Geel - Belgium.

· Or by shipping to our warehouse Sportief BV Meerhoutseweg 53, 2440 Geel.

 

Article 6. Duration of the agreement

An agreement will only be concluded after the Customer's order  has been confirmed by Www.modekleding.be by  e-mail to the e-mail address provided by the Customer.

Article 7. Retention

The delivered items remain the exclusive property of www.modekleding.be until the moment of full payment by the Customer  .

If necessary, the Client undertakes to  draw the attention of third parties to the retention of title of www.modekleding.be, e.g. to anyone who comes to seize the items that have not yet been paid for in full.

Article 8. Right of withdrawal (return policy)

We currently use free shipping only valid for complete purchase. This can be changed at any time. (This is only valid for Belgium, the Netherlands and Germany). If a return is made, it is no longer a complete purchase, and the free shipping will expire, and shipping/return costs must be paid, these shipping costs will be deducted from the refund of the returned clothing. For items in sales, Promo, tying, and other offers, shipping costs must be paid, the shipping amount to be paid depends on the shipping company and can be found in your shopping cart.


Since Modekleding (Sportief BV) offers these products online and they are therefore purchased online by the customer, this falls under distance selling.

In the case of distance selling, the customer has a right of withdrawal of 14 calendar days. As Article 46 of the Market Practices and Consumer Protection Act, §1.2 indicates:

The consumer has the right to inform the company that he is withdrawing from the purchase, without payment of a penalty and without giving any reason, within 14 calendar days from the day following the delivery of the goods or the conclusion of the service contract.

Since we sell clothing and therefore not a service, this means that from the day after delivery, one can change one's mind.

A copy of a proof of purchase or order number or invoice number of the customer must be provided in writing. The package must be returned to Sportief BV, Pas 18, 2440 Geel Belgium, within 14 calendar days.

The customer will receive a confirmation email from Modekleding.BE containing the necessary shipping documentation.

The customer sends the package back to our warehouse Sportief BV, Meerhoutseweg 53, 2440 Geel.
The costs for shipping and returning are fully borne by the customer, if a return is made. For Belgium  = 10€ (this is the amount we have to pay to the shipping company)For the Netherlands = 10€ (this is the amount we have to pay to the shipping company)For Germany = 15€  (this is the amount
 we have to pay to the shipping company)
This amount is deducted from the amount to be refunded for the clothing.


If you decide to keep the entire purchase, you do not pay shipping and return costs

. You can return for free in our store.
You return the garment in new condition and unworn as it was delivered, via personal delivery, in our shop Sportief Modekleding - Pas 18 - 2440 Geel Belgium.

When the returned goods are complete, undamaged and unused, we will refund the purchase price paid by you (this is minus the shipping/return costs) as soon as possible (but no later than within 30 days) to your account with which you paid.Sales

items (Sales, tying sales, sales with discounts) are non-refundable, for which you will receive a voucher that must be spent within the year.
When purchasing sales items under 75€, shipping costs must be paid.
 

For a quick settlement, always attach a copy of the purchase invoice/confirmation email with the mention 'cancellation' This return document can be requested via info@modekleding.be

The package must be returned to Sportief BV in a proper packaging of your choice.

If the clothing is damaged by shipping or is lost, you can no longer count on compensation.


The provisions of this article only apply to Customers who, in their capacity as consumers, purchase items online from www.modekleding.be. The Customer has the right to withdraw from the agreement within a period of 14 calendar days, provided that the specific reasons are stated in accordance with the return conditions in the annex to these Terms and Conditions, which can also be consulted publicly on the Webshop at any time. The withdrawal period expires 14 calendar days after the day:

  • on which the Customer or a third party designated by the Customer, who is not the carrier, acquires physical possession of the goods;
  • on which the Customer or a third party designated by the Customer, who is not the carrier, acquires physical possession of the last good;
  • on which the Customer or a third party designated by the Customer, who is not the carrier, acquires physical possession of the last shipment or component.

 

In order to exercise the right of withdrawal, the Customer must  inform www.modekleding.be of  its decision to withdraw from the contract by means of an unambiguous statement (e.g. in writing by post or e-mail).

In case of withdrawal, it is expected that your items will be returned in proper packaging and unused. If not, your items will not be subject to the withdrawal conditions and we will not be able to allow an exchange.

In order to comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the expiry of the withdrawal period.

The Client must return the goods to www.modekleding.be without delay, but in any event no later than 14 calendar days after the day on which he has notified www.modekleding.be of his decision to withdraw from the contract  . The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods will be borne by the Customer.

If the returned product is depreciated in any way, www.modekleding.be reserves the right to hold the Customer liable and claim compensation for any depreciation  of the goods  resulting from the Customer's use of the goods beyond what is necessary to improve the nature,  determine the characteristics and functioning of the goods.
When sending via Bpost, PostNL, DpD, the clothing must be packed and taped securely and watertight in a good box or bag of your choice.

· The original factory label and labels must not be removed from or removed from clothing.

· If the clothing is damaged by shipping, this is the responsibility of the customer.

· If the clothing is damaged due to insufficient packaging, it can no longer be exchanged.

If the Customer withdraws from the agreement, www.modekleding.be will  refund all payments received from the Customer up to that point minus the shipping/return costs to the Customer within a maximum of 14 calendar days after www.modekleding.be has received the returned product for inspection of good condition. www.modekleding.be will therefore withhold the refund until we have received all the goods back, whereby www.modekleding.be can refuse the refund if visible damage has been caused to the goods that makes the goods unusable for further resale.

www.modekleding.be reimburse the Customer using the same means of payment as the Customer used to carry out the original transaction,

The Client may not exercise the right of withdrawal for:

  • the delivery of goods manufactured to the Client's specifications, or which are clearly intended for a specific person or occasion;
  • the supply of goods that spoil quickly or have a limited shelf life;
  • the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery. For example, our refills can be returned if the packaging is unopened and the sealing has remained intact.

Article 9. Guarantee

www.modekleding.be cannot be held liable under any circumstances or in any way for damages of any kind that may result from the improper use of the marketed products.

The liability of www.modekleding.be cannot be held liable for possible changes to the products made by the manufacturers.

In any case, www.modekleding.be's liability  will be limited to the amount of the order.

Under the law of 21 September 2004 on the protection of consumers in the sale of consumer goods, consumers have legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee shall be without prejudice to these rights. In order to invoke the warranty, the Customer must be able to provide proof of purchase.

For items purchased online and delivered to the Customer's home, the Customer must contact www.modekleding.be in advance and  return the item to www.modekleding.be at his expense  .

If a defect is discovered, the Client must  inform www.modekleding.be as  soon as possible. In any case, any defect must be reported within a period of 14 calendar days after it has been discovered by the Client. Afterwards, any right to repair or replacement expires.

The legal guarantee never applies to defects resulting from accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, modifications or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use. It also does not apply to articles with a shorter lifespan or wear and tear articles.

Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable, delivery, are deemed not to be hidden defects, unless proven otherwise by the Customer. The warranty is non-transferable.

Article 10. Customer service

Article 11. Penalties for non-payment

Without prejudice to the exercise of any other rights available  to www.modekleding.be,  in the event of non-payment or late payment from the date of the default, the Client shall owe interest at the rate of 10% per annum on the unpaid amount by operation of law and without notice. In addition, the Client is required by operation of law and without notice to pay a lump sum compensation of 10% of the amount in question, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, www.modekleding.be reserves the right to take back items that have not been (fully) paid for.

Article 12. Privacy

The data controller, Sportief BV, respects the Belgian law of 8 December 1992 on the protection of privacy in the processing of personal data and the General Data Protection Regulation of 27 April 2016.

The personal data provided by you will only be used for the following purposes:

  • the execution of the concluded agreement;
  • processing the order, sending newsletters;
  • advertising and/or marketing purposes;
  • ensure the management and control of the performance of the services offered;
  • sending and following up on orders and invoicing;
  • sending promotional information related to the products and services;
  • the possible sending of free samples or the offering of services on more favourable terms;
  • answering users' questions;
  • the realisation of statistics;
  • improving the quality of the website and the products and/or services by the data controller;
  • Forwarding information regarding new products and/or services by www.modekleding.be
  • Direct marketing purposes: allow the user's interests to be better identified.

 

You have a legal right to inspect and correct your personal data. Subject to proof of identity (copy of the front of your identity card), you can obtain a written notification of your personal data free of charge to www.modekleding.be by means of a written, dated and signed request  . The failure  of www.modekleding.be at any time to enforce any of the rights  enumerated in these Terms, or to exercise any right thereof, shall never be deemed to be a waiver of such provision and shall never affect the validity of such rights.

Article 14. Modification of terms and conditions

These Terms and Conditions are supplemented by other terms and conditions expressly referred to and the general terms and conditions of sale of www.modekleding.be . In the event of a conflict, these Terms and Conditions shall prevail.

www.modekleding.be may change these Terms at any time without notice. Any purchase made after the modification constitutes acceptance by the Customer of these new Terms and Conditions.

Article 15. Proof

The Client accepts that electronic communications and back-ups may serve as evidence.

Article 16. Applicable law - Competent court

Belgian law is applicable, with the exception of the provisions of private international law on applicable law and the Rome I Regulation on contracts for the international sale of goods. In the event of any disputes, the courts in Kortrijk are exclusively competent.

When you place the order, there is an acceptance of the terms and conditions. After that, the Customer must complete the order form completely and correctly. Before the order is placed, the Customer receives an overview and can make corrections. Appendix 2: Return conditions

You have up to 14 days after receiving your package to register your return via the websiteThis is the only way we will take items back.

Make sure that all items still have the original tags and tags and that they are unworn and undamaged. We appreciate that we get the items back the same way you received them.

You register a return via email  to info@modekleding.be and indicate which item from your orders you wish to return. You indicate the reason for return. You pack the returned item in a sturdy package and provide it with a shipping label and bring it to a post office.

The responsibility for the return lies with you until the package reaches us, so don't forget to ask for proof of shipment when you go to send the package.

The package must be returned in its original packaging, with original tags and labels, and the items must be undamaged and show no signs of use.

When the return package and returned items have been received and processed in good order, you will receive a confirmation via e-mail. We aim to provide a refund within 7 working days after processing the return. In any case, reimbursement will be made within the statutory period of 14 days.

We cannot take back the goods if we suspect that the items have been worn more often than during the fitting.

An exchange of an item is not possible, you must re-order the desired size online on the website.

Have you received a damaged product or a complaint about a product? These items cannot be sent as a regular return package, but must be reported to customer service via info@modekleding.be. Describe the complaint as clearly as possible and state the order number, article number and send a photo of the complaint.

Images and textual material:

Sportief BV tries to provide a clear and truthful representation of the products. Minor deviations in color are possible, for which Sportief BV cannot be held responsible. This also applies to any typesetting or printing errors on the webshop, invoicing and mailings.

Praise

Prices will not be increased within the duration of the offer, unless this is required by law or if the manufacturer implements price increases in the interim. All prices on the site are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors. All prices are in Euro and include 21% VAT. Price changes will be clearly indicated.

Gift vouchers and vouchers:

When you have received a gift voucher or voucher, you can use it for a purchase in the webshop. The webshop works with a coupon that can be purchased online. During the purchase, you indicate that you have such a coupon. It is then recognized via a unique code and the price is deducted from the value of the voucher. This voucher can only be used 1 time and must be used up completely. A possible residual value, when one buys for a lower amount, cannot be returned. Modekleding.BE is not liable for unusable codes due to casual use after purchasing the coupon. Online coupons can only be used online and our gift vouchers can only be used in store.

Governing Law

In the event of a dispute, Belgian law will prevail and will therefore be submitted to a competent court in Turnhout.
